Patriot Scientific "speculative buy," target price reduced

NEW YORK, April 11 (newratings.com) - Analyst Richard W West of JM Dutton reiterates his "speculative buy" rating on Patriot Scientific Corp (PTSC). The target price has been reduced to $0.55.

In a research note published yesterday, the analyst mentions that the company has reported its license revenues for the three months ending February 29, 2008 significantly short of the estimates. Being a passive partner in the JV with Technology Properties Limited, Patriot Scientific is completely dependent on the failure or success of the former company's licensing and prosecution initiatives, the analyst says. This suggests that Patriot Scientific needs to use its cash for acquiring revenue- and earnings-generating companies, JM Dutton adds.

fahren keinen porsche und finde ...so wie du ..immer den optimalen ein und ausstiegspunkt...
aber dafür gibt es ja die ganz klugen ...

killer...geb Dir zum Teil recht.  Aber lass es uns nicht zu sehr wie im anderen Beitrag mit berndnase und Co. hier streiten.
Den richtigen Ein- und Ausstieg zu erhaschen ist doch immer das Wichtigste und ein Patentrezept gibts nun mal einfach nicht.  Wer clever, viel Zeit und Geld hat kann sicher die Indikatoren nutzen und ein paar Euro mehr oder weniger rausholen.
Für uns heissts bei solchen Werten Alles oder Nichts... Ich schau zwar auch fast täglich rein, aber reagieren (verkaufen/kaufen)kann ich nur am Abend...
So...gehe jetzt meinem realen Job weiter nach, der mir am monatsende meine verdiente Rendite einbringt.

Wenn negativ für PTSC - dann raus, versteh ich.
Wenn positiv für PTSC - dann raus?????

Bin Investor, kein Zocker!!! Möchte nicht, dass mein finanzieller Erfolg von der Entscheidung einer Behörde abhängt, deren Ausgang niemand prognostizieren kann. Mit der Spekulation auf Urteile/Entscheidungen sind schon viel auf die Nase gefallen (siehe etwa die Sache DEWB/Jenoptik). Wenn die Patentamtentscheidung vollständig positiv ausfällt (was ich persönlich nicht glaube), geht es natürlich mit dem Kurs erheblich aufwärts. Aber auf diesen Glücksgewinn kann ich verzichten. Die bisherigen Gewinne durch Traden waren m.E. nahezu ohne größeres Risiko, da der PTSC-Kurs halt seit Jahren berechenbar ist.

Entgegen der Ansicht mancher User hier braucht man zum Traden übrigens keine Millionen. Nur kommt man durch Traden schneller zur Million (jedenfalls bei so volatilen Werten wie PTSC). Gerade bei Usern, die über weniger finanzielle Mittel verfügen, halte ich es für riskant, vor einer solchen Entscheidung investiert zu sein (da kann man auch ins Casino gehen).

Gönne den Longies ja auch eine positive Patentamtsentscheidung. Hätten sie verdient. Auch wenn sie ihren Frust immer an anderweitig Investierten auslassen müssen (die nun wirklich nichts für den Kursverlauf können, diesen nur vorhergesehen haben...).

Ich bin übrigens gestern wieder eingestiegen, weil das Angebot einfach zu verlockend war.....

Genau kann man das nicht festmachen. Zumal es ja nicht eine Entscheidung geben wird, sondern voraussichtlich zu jedem der Patente eine eigene. Ich denke aber, dass ab Mai jederzeit mit einer Entscheidung gerechnet werden kann (bei agoracom gibt es diverse Berechnungen und Einschätzungen). Bis Ende April werde ich daher auch investiert bleiben, nachdem ich gestern wieder eingestiegen bin.

Naja, ein gewisses Risiko gehe ich damit dieses mal auch - das Patentamt könnte sich ja wider Erwarten schon im April melden...sic!

After reading and thinking about all the pieces of information we got especially after the last quarter results quite a nice picture has emerged in front of my mind’s eyes. Into this picture the parts of the mysterious revenue puzzle seem to fit perfectly, at least for me. While considering important announcements, reports and other news we got so far I will not go into any detail as I think most of the details were discussed sufficiently by more capable people than me. But let me share my combining (some thoughts are surly not new but in the context worth being repeated) of those facts we have.

In my opinion we are getting recurring revenues since the settlement in December for which many here and also members of BOD were asking constantly. Reasons for this theory:

1. Turley’s statement, “we now have tens of millions” which anybody knows. Did Turley deliberately lie when he said that?

2. The last bigger licensee with a onetime payment was Philips. They roughly paid 18 mil dollars which Lambert showed in his list. Btw. that was quite a lot if you look at the parts of the company which actually paid. The time they signed was just before the great settlement. I believe they were one of the last if not the last company at all to get some sort of early mover abatement. Why should Philips pay much money shortly before settlement if the J’s could get away with peanuts just a few days ahead? Do you think their attorneys didn’t communicate with the J’s ones? From my own experience with patent licensing I know that everything is examined extremely thoroughgoing. No company would pay even a penny if they hadn’t to. They choose as we know for sure a onetime payment and the only reason I can think of is that this was cheaper and more comfortable for them than to pay royalties.

3. The 10Q didn’t show the big money we all were looking for. Does anybody really believe that the J’s came away with a few millions after Philips paid 18 mil. at the last minute before court was closed, after an army of patent attorneys had shown validity of the patents by telling their clients to pay heavy money, after a positive Markman or after the wording of the settlement was, “all parties are pleased”? Thinking logical the money must be hidden somewhere else because it didn’t show up where and when it was supposed to do. I think “business resolution” points to usual license payments. The licensee pays some 3 or 4% of the sales price of the infringing products as long as he or she sells those products or till the date of expiry of the patents. That is just business as usual. But why then does the expected income didn’t show up in the 10Q. At this point I’m of Milestone’s opinion that the reexams have to be accomplished first. Another reason could be that the infringing products have to be ascertained first before there can be made an exact payment which is not that easy if you have a lot of them. Much easier is a onetime payment.

4. Some announcements in January had words like “chain disruptions” or similar in them. For me (I Think Deb or Dave said this before) this shows that the production of infringing hardware will be stopped if no constant payment transactions are made.

5. When Goerner joined the board he told us that his designated target was M&A and he even made his salary depending upon this aim somehow. If you look at the money PTSC has got at the moment they are not able to merge with or buy something satisfying. What makes the CEO to go after M&A if there is not enough money? What I think is he knows about recurring revenues and therefore he also knows for sure that any bank will be glad to lend a company with safe income during the next seven years some money. Do I remember right, haven’t there been some talks to a bank recently?

6. The relatively small earning in the 10Q if you look at the pure numbers seems to indicate that this was just the start of the new way of licensing. This fits in with Goerner’s statement, “…which fully reflects the financial results of all transactions announced prior to the end of January2008”. The way in which this is said for me clearly shows that there are more transactions to come after January. If the number of the J’s had been fully included he would have said, “…financial results of all licenses prior to the end of January 2008”. I guess that with each new license the amount of money will steadily grow from quarter to quarter.

Finishing my guess, I want to tell you that I consider pure pumping to be utterly different from demure weighing, which for sure can lead to optimism. Yes, I’m very optimistic but if one considers the hard facts, tries to combine, doesn’t look at the share price all the time can you tell me one reason that really makes sense to be pessimistic being invested in this stock?

I don’t like to wear rose coloured glasses because I want to see clear and through clear glasses or with good eyes which don’t need any glasses the future of this company looks nothing more than bright.

If I missed anything while being too sketchy, got anything wrong or falsely interpreted or whatever I appreciate your correcting me.

Isn't interesting to see that all along, after the Markman Ruling, Toshiba, Matsushita, Panasonic, NEC and JVC were planning on settling the case. The parties above, including ARM Ltd., stipulated to an entry of judgment as to claim 29 of the '584 patent, effecting an expedited appeal to the Federal Circuit Court.

If Toshiba, Matsushita, Panasonic, NEC and JVC felt so strong on non-infringement or invalidity of the '336 and '148 patents, why didn't they appeal Judge Ward's Markman Ruling as to the '336 and '148 patents.

Oral argument between TPL/PTSC and ARM Ltd is set for 5/6/08, less than 2 weeks away, before a panel of 3 federal circuit judges - each judge having a staff of 2-3 law clerks (resumes of some usually include BS in Engineering - and who are or will become future patent attorneys) :

"As we have noted in prior public announcements, we believe that the claim construction for 'instruction groups' requires more scrutiny than the Texas Court was able to give it during the Markman hearing due to time and space constraints," said Dan Leckrone."

I hope oral argument follows through - no ARM settlement! I want the Federal Circuit to tackle and digest the '584 patent.

"Leckrone noted that ARM issued a news release on September 20, 2007 that "was misleading" in that it implied the Texas Court somehow passed a judgment of non-infringement in favor of ARM. In point of fact, it was TPL who initiated the partial non-infringement stipulation to pave the way for a speedier trial and TPL's opportunity to appeal the single Markman ruling on the "instruction groups" claims construction. He declared, "The fact that TPL gave ARM a judgment of non-infringement was purely procedural as well as temporary until the reversal of the US '584 ruling."According to Leckrone, all ARM core families (ARM7, ARM9, ARM9E, ARM10E, ARM11) and the ARM Cortex microprocessor core family do infringe upon the US '584 as well as US 5,440,749 in the MMP Portfolio. He warned that all manufacturers of end user products using infringing ARM processors - with the exception of the 20 global manufacturers who have already purchased MMP Portfolio licenses - are infringers of technology protected by the MMP Portfolio. "The longer infringers wait to purchase an MMP license, the more they can expect to pay because our program is designed to reward first-movers in various industry categories."
